Two jarring results concerning the main theses of Georg Henrik von Wright's Explanation and Understanding are reached through an examination and criticism of his project. It is shown, contrary to his settled judgment both in EU and subsequently, that the schema of practical inference is a causal principle, and that it is nomological in character. But one feature of von Wright's overall analysis holds up and continues to show promise: his idea of understanding explanation. This idea combines the EU account (...) of the schema and its instantiation with the notion of an intelligible connection of these instantiating elements with one another. Here the schema is deployed in conjunction with the test of intelligible connection as one of its conditions of application. The schema, so deployed, is revisable on the basis of experiences that do not conform to what we expect them to be when they are regimented in accordance with the model of understanding explanation; thus, even though the schema is not a general law, we have a basis for characterizing it as nomological, nonetheless. The first section takes up some main details of American constitutional history. At the end of that section and in section two, we concentrate on one constitutional doctrine in particular, judicial review. We argue that this doctrine rests, traditionally, on the foundational idea of a permanent tension between democratic institutions and basic rights. In section three, we deal with the problem just raised, by suggesting an alternative view of the relationship that exists between these fundamental constitutional elements. Here we attempt (...) to show that there is an essential principled harmony between basic constitutional rights and democratic majority rule. And we try to locate judicial review within this alternative conception. It has been claimed that several of the rights in the UN’s Universal Declaration of Human Rights - in particular the social and economic rights to the provision of welfare in, for example, education - cannot literally be rights of everybody. We find two main lines of analysis that have been raised to back up this claim. One of these lines is theoretical or normative in nature. Here I take up Onora O’Neill’s concern with the counterpart obligations that attach to (...) the UDHR social and economic rights. She argues that these obligations do not have a universal character and cannot backstop universal moral rights. I suggest ways around her argument. The other main line concerns feasibility. Here I take up the argument that the UDHR social and economic rights apparently cannot, under existing conditions, be fulfilled at even a minimal level for millions upon millions of people. James Nickel, well aware of this problem, argues that these rights nonetheless do not, on grounds of infeasibility, fail of universality. I try to counter his argument. But I add, in conclusion, that these pressing practical problems with the UDHR welfare rights could possibly be removed in time, with concentrated effort. (shrink)

Something of the nature of Rotenstreich’s book can be gained from its title. The main title suggests a coherent and unified account of Hegel’s “shift” from substance to subject; the subtitle, however, seems to point in a somewhat different direction and to suggest a collection of essays on a variety of Hegelian topics. Actually the book itself falls somewhere between the coherence of a single thematic treatment and the diffuseness of a set of disparate essays. Hence, though the shift from (...) substance to subject is the “principal concern”, the “running thread” of his book, Professor Rotenstreich manages in it to touch on a great number of subjects in Hegel’s systematic philosophy. Accordingly, most of the chapters could be read as independent essays, with some of them seeming further afield from the central theme - the shift - in Hegel’s system than do others. (shrink)

To what extent should states accommodate religious liberty claims? Can the pluralist state be neutral between religions and secularism? This book explores contemporary legal controversies regarding the protection of religious liberty from a theoretical and comparative perspective, looking at issues such as family and parenting, medical treatment, education, employment, religious group autonomy, and freedom of expression.

What is the role of cultural archives in creating and sustaining connections between diasporic communities? Through an analysis of an audiovisual archive that has sought to bring together representations of and by African, Caribbean and Asian people, this article discusses the relationship between diasporic film, knowledge production and feminist solidarity. Focusing on a self-curated, UK-based archive, the June Givanni Pan-African Cinema Archive, we explore the potentiality of archives for carving out spaces of diasporic connectivity and resistance. This archive assembles (...) the holdings of pan-African films and film-related materials, built over several decades by June Givanni, a Guyanese-born London-based film curator. Givanni’s archive embodies her long relationship with the intersecting worlds of African and Asian diasporic cinema, which hold deep connections to Black British heritage through global networks spanning across empire. In the making of this cultural analysis, we employ a co-produced, decolonial methodological approach by designing and producing the article in collaboration with Givanni over a two-year period. We aim to foreground the role of feminist labour (academic and practitioner) as agents of change who are reclaiming stories, voices and memory-making. The wider backdrop to this co-produced analysis is the ongoing resilience of a cultural amnesia that has pervaded the Black British experience and the current fragility of Black arts and cultural spaces in the UK. Our question is how might archives help us map the connections between racialised ideas of belonging, memory politics and the reconfiguration of colonial power whilst also operating as a site of feminist connectivity? In the first section of this paper, I articulate Jaegwon Kim's argument against emergent down ward causation. In the second section, I canvas four responses to Kim's argument and argue that each fails. In the third section, I show that emergent downward causation does not, contra Kim, entail overdetermination. I argue that supervenience of emergent upon base properties is not sufficient for nomological causal relationsbetween emergent and base properties. What sustains Kim's argument is rather the claim that emergent properties realized (...) by base properties can have no causal powers distinct from those base properties. I argue that this is false. An Essay on Metaphysics is one of the finest works of the great Oxford philosopher R. G. Collingwood : in it he considers the nature of philosophy, especially of metaphysics, and puts forward his original and influential theories of absolute presuppositions, causation, and the logic of question and answer. Three fascinating unpublished pieces by Collingwood have been added for this revised edition: they illuminate and amplify the ideas of the Essay, to which they are closely related. The editor Rex Martin (...) contributes a substantial introduction telling the story of the composition of all these works, discussing their major themes, and setting them in the context of Collingwood's philosophy as a whole. I argue that, on plausible assumptions, anomalous entails monism epiphenomenalism of the mental. The plausible assumptions are (1) events are particulars; (2) causal relations are extensional; (3) mental properties are epiphrastic. A principle defender of anomalous monism, Donald Davidson, acknowledges that anomalous monism is committed to (1) and (2). I argue that it is committed to (3) as well. Given (1), (2), and (3), epiphenomenalism of the mental falls out immediately. Three attempts to salvage anomalous monism from epiphenomenalism of the (...) mental are examined and rejected. Here we review 37 modern neuroimaging studies in an attempt to address this question posed by Halstead (1947) as he and other icons of the last century endeavored to understand how brain and behavior are linked through the expression of intelligence and reason. Reviewing studies from functional (i.e., functional magnetic resonance imaging, positron emission tomography) and structural (i.e., magnetic resonance spectroscopy, diffusion tensor imaging, voxel-based morphometry) neuroimaging paradigms, we report a striking consensus suggesting that variations in a distributed network predict (...) individual differences found on intelligence and reasoning tasks. We describe this network as the Parieto-Frontal Integration Theory (P-FIT). The P-FIT model includes, by Brodmann areas (BAs): the dorsolateral prefrontal cortex (BAs 6, 9, 10, 45, 46, 47), the inferior (BAs 39, 40) and superior (BA 7) parietal lobule, the anterior cingulate (BA 32), and regions within the temporal (BAs 21, 37) and occipital (BAs 18, 19) lobes. White matter regions (i.e., arcuate fasciculus) are also implicated. The P-FIT is examined in light of findings from human lesion studies, including missile wounds, frontal lobotomy/leukotomy, temporal lobectomy, and lesions resulting in damage to the language network (e.g., aphasia), as well as findings from imaging research identifying brain regions under significant genetic control. Overall, we conclude that modern neuroimaging techniques are beginning to articulate a biology of intelligence. We propose that the P-FIT provides a parsimonious account for many of the empirical observations, to date, which relate individual differences in intelligence test scores to variations in brain structure and function. Moreover, the model provides a framework for testing new hypotheses in future experimental designs. (shrink)

For these reasons, there is a need for competently designed noise standards to safeguard community health and well-being. The authors identify key considerations for the development of wind turbine noise standards, which emphasize a more social and humanistic approach to the assessment of new energy technologies in society.

The sentence that comprises 5.31.5 in Caesar's Bellum Gallicum has long been felt to be problematic. It was deleted entirely by H. Meusel. A. Klotz posited a lacuna after quare. Others sought smaller adjustments. Yet, the defence of the text as transmitted also drew advocates and the debate quietened. The current Teubner edition, by W. Hering in 1987, prints the transmitted text and does not acknowledge the debate in the apparatus criticus. I propose a new solution, one that reinterprets the (...) sentence in context and requires a small textual change from et to nec. I will first set the context and identify problems with the conventional understanding of 5.31.5. (shrink)

This article argues that secularism is not neutral. Secularization is a process, the secular state is a structure, whereas secularism is a political philosophy. Secularism takes two main forms: first, a “benevolent” secularism that endeavours to treat all religious and nonreligious belief systems even-handedly, and, second, a “hostile” kind that privileges unbelief and excludes religion from the public sphere. I analyze the European Court of Human Rights decision in Lautsi v Italy, which illustrates these types. The article concludes that secularism (...) as a political philosophy cannot be neutral, and the secular state is not neutral in its effects, standpoint, governing assumptions or treatment of religious truth claims.
